These Terms of Use ("Terms") constitute an agreement between you and ZivaOne that governs your access to and use of Ziva's products, software, and services, as described on https://zivaone.com/launch/ ("Website") and any related mobile or software applications, including the ZivaOne mobile application ("App"). Collectively, the Website, App, and related online tools are referred to as the "Platform."
In this agreement, "You" and "Your(s)" refer to any individual, firm, company, or legal entity that accesses or uses the Platform. Your use of the Platform is also subject to our Privacy Policy, which outlines how we collect, use, share, and store your personal information, along with any additional policies and terms provided by us.
Your consent:
Please read these terms thoroughly. By accessing or using the application, you agree to abide by and be bound by them. If you do not agree to these terms, you should not use the ZivaOne application.
Health disclaimer and release:
This application may provide information related to exercise and fitness for your personal use and informational purposes only. It is not intended to replace or serve as a substitute for professional medical advice, diagnosis, or treatment.
Before starting any exercise, fitness, diet, or nutrition program, especially if you are pregnant or have existing health conditions, you should consult with a physician. The content on the platform should not be viewed as medical advice or diagnosis.
You assume all risks associated with participation, including but not limited to, falls, contact with other participants, adverse weather conditions such as high heat and humidity, and other similar risks, which you acknowledge and accept.
Your representations and warranties:
When you access the application, you represent and warrant that:
- If you are an individual
- You are at least 18 years old or have reached the age of majority in your jurisdiction;
- You have the legal capacity to enter into and fulfill binding contracts under applicable law;
- All information you provide is accurate, current, truthful, and complete.
- If you are representing a corporate entity or firm:
- You have the full legal authority to bind that entity to these Terms;
- The entity is properly organized, legally existing, and in good standing under applicable laws;
- All information you provide is accurate, current, truthful, and complete.
You agree and confirm that your use of the application will comply strictly with all applicable laws.
RETURN & REFUND
Return:
If the product or package you receive is damaged, missing parts, does not match the description on our platform, or is defective, you must contact us within 24-48 hours of delivery to report the issue. To facilitate a successful return, please keep the products in their unused, original condition and include the following items:
- Original invoice or sale receipt
- Brand outer box
- MRP tags
- User manual
- Original accessories in manufacturer packaging
We will process return requests in accordance with this policy. Returns will not be accepted if:
- You ordered the wrong product size or color.
- You fail to report the damaged, defective, or incorrect product within the specified return period.
For products under warranty, we will inspect the item first. If a manufacturing defect is confirmed, we will repair or replace the product within 90 days of verification and notify you accordingly.
Refund policy:
Cancellations:
Once the cancellation is successfully processed, we will issue the refund within 5 to 7 working days. The refunded amount will be credited to the original payment method used for the transaction.
Returns:
For returns, we process refunds within 5 to 7 working days of receiving the product. The timing may vary depending on the payment method used, such as Credit/Debit cards, Net banking, or Cash on Delivery.
WARRANTY
The ZivaOne Smart Ring includes a 12-month warranty starting from the date of purchase. This warranty covers any manufacturing defects in the hardware.
Warranty coverage
- For any manufacturing defects, we will inspect the product and either repair or replace it within 90 days of verifying the warranty claim.
- The warranty is only valid in India or the location where the product was purchased and does not extend internationally.
- This warranty covers only manufacturing defects and does not include damage resulting from:
- Normal wear and tear
- Connection to incompatible devices
- Improper alterations of the product
- Use beyond the product’s intended purpose
- Unauthorized repairs or modifications
- Misuse or accidents of any kind
SHIPPING POLICY:
- Delivery usually takes between 3 to 7 business days from the order date, depending on your location.
- If we cannot deliver the product within this timeframe, you have the option to either cancel the order or wait for the product to arrive.
- Your order may be canceled if the product is unavailable or if you request cancellation due to a delay in delivery.
- The company is not responsible for any direct or indirect damage or loss resulting from order cancellations or delivery delays.
